General information, not tax, legal or financial advice. We are not the IRS. Check IRS.gov or a qualified tax professional. Sources read on October 17, 2026. The 2026 Form 709 instructions were still a draft ("DRAFT", dated September 2, 2026) when read, so anything taken from them is expected and must be rechecked against the final version. Short answer: the 2026 Form 709 is due April 15, 2027, which is a Thursday, so no weekend shift is expected this year. If you request an extension, the extended date is expected to be October 15, 2027 (6 months later, a Friday); the extension does not give more time to pay. If a due date falls on a weekend or legal holiday, it moves to the next business day (IRS due-date chart; draft 2026 instructions, section 7503).

The rule

Form 709 is an annual return. Generally you file it no earlier than January 1 and no later than April 15 of the year after the gift was made. The IRS chart for the 2026 tax period (ending December 31, 2026) shows a due date of April 15, 2027.

If the donor died in 2026

The draft instructions say the executor files the donor's 2026 Form 709 by the earlier of the due date (with extensions) for the estate tax return, or April 15, 2027 or the extended due date granted for the gift tax return.

Penalties

The draft says section 6651 imposes penalties for both late filing and late payment unless there is reasonable cause. If you receive a notice after filing, send an explanation; do not attach one to the return. We give no penalty percentages.

Extensions

Two ways to extend the time to file; neither extends the time to pay. See Form 8892 vs Form 4868.

E-filing

The IRS describes Modernized e-File for Form 709 and says a return with a balance due can be e-filed with an electronic funds withdrawal; see IRS.gov/GiftEfile.

FAQ

Is it the same date as my income tax return? For many calendar-year filers, yes, expected April 15, 2027; but the two are separate returns.

Do I file if I owe nothing? If the filing rules apply, yes; see who must file.
